Before you file anything
Register your copyright with the U.S. Copyright Office at copyright.gov first. Registration unlocks statutory damages of up to $150,000 per work and attorney's fees under 17 U.S.C. § 412. What Happens After You File
Once you submit a valid DMCA notice, the platform must "respond expeditiously to remove, or disable access to" the infringing material under 17 U.S.C. § 512(c)(1)(C). In practice:
- The platform removes the content and notifies the uploader
- The uploader may file a counter-notice under 17 U.S.C. § 512(g), swearing the content is not infringing and consenting to federal court jurisdiction
- If a counter-notice is filed, the platform must restore the content within 10-14 business days unless you file a lawsuit and notify the platform
- This is why copyright registration matters: if you have a registration, you can file suit immediately. Without it, you cannot file suit at all under 17 U.S.C. § 411(a)
Counter-notice alert
If the fraudster files a counter-notice, do not panic. The counter-notice requires them to swear under penalty of perjury that they have a good faith belief the material was removed by mistake. A fraudster who knowingly stole your music cannot honestly make that statement. Their counter-notice is itself a potential source of additional liability. But you must be ready to file suit within the 10-14 day window. This is why we recommend filing copyright registration before you send your first takedown.
Demand for Profile Ownership Transfer
If someone created a profile under your artist name or uploaded your music under a fake identity, you can also demand that the platform transfer ownership of the profile to you. This is not a DMCA takedown. It is a demand based on identity theft and false designation of origin under the Lanham Act, 15 U.S.C. § 1125(a).
